Terms of Service

PHONYX is operated by I.E. Aleksei Iurasov, registered in Georgia. You can reach a person at support@latentstate.dev.

Purchases are handled by Paddle, which is the merchant of record and the seller for every transaction. That means Paddle — not us — is your counterparty for the payment itself, and Paddle’s own terms apply to it. These terms cover the service you get afterwards.

You add a text, read it aloud, and the app records you, transcribes what it heard, compares it against the text and shows you where the two diverged — with scores, per-word drills and a reference pronunciation for most languages.

It is a practice aid. It is not a certified assessment, it is not a qualification, and its scores should not be relied on for anything that matters to somebody other than you. Speech recognition makes mistakes, and it makes more of them on accented speech.

One account is for one person. Keep your password to yourself — anyone holding it can read and delete everything in your account.

You need to confirm your email address before you can record. That is deliberate: recording spends money on transcription and analysis, and an unverified address is not a person we can reach.

You must be at least 16, or older if the age of digital consent where you live is higher.

The service is metered in practice minutes. Your balance is what you were granted or bought, less what your reading has consumed. A new account arrives with a free allowance so you can try the thing before paying for it.

Minutes are not money. They are not transferable, they cannot be cashed out, and they have no value outside the service. They do not expire.

A recording already under way is allowed to finish even if it takes your balance below zero — throwing away a reading somebody just did, over arithmetic they could not see, is the worse outcome. The next recording is then refused until you top up.

Minutes are sold in packages. The price you see at checkout is the price you pay: depending on where you are, tax is either included in it or added on top, and Paddle shows you which before you confirm.

Minutes are credited automatically as soon as Paddle confirms the payment, usually within seconds. If they do not arrive, email us — we can see whether the payment reached us and credit it by hand.

Refunds are covered by the refund policy, which is a separate page and part of these terms.

They stay yours. You give us only the permission needed to run the service on them: to store them, to send audio for transcription, to send the transcript for review, and to show the results back to you.

Do not upload text you have no right to use. Do not record anyone but yourself.

We do not use your recordings to train models, and we do not sell them or share them with anyone beyond the processors listed in the privacy policy.

You can create a link to a single reading. Anyone with the link can see it, so treat it as public — though the page asks search engines not to index it.

The recording itself is NOT included unless you deliberately turn it on for that link. You can revoke a link at any time, and a revoked link stops working immediately.

Do not use the service for anything unlawful. Do not try to break it, overload it, work around its limits, or automate access to it. Do not share your account.

We may close an account that does these things, and we will tell you why.

PHONYX is in beta. There is no uptime guarantee, features may change or be withdrawn, and occasionally something will be broken. The database and the recordings are backed up every night, and the database again before every deployment — on the same server, so a lost server would take the copies with it. Do not treat the service as the only home for anything you cannot lose.

You can delete your account whenever you like, from Preferences. It is immediate and permanent — see the privacy policy for exactly what goes and what remains.

We may close an account that breaches these terms. If we close yours and you still hold minutes you paid for, ask us and we will refund the unused ones.

The service is provided as it is. We do not promise it will be uninterrupted, error-free, or that its analysis is accurate.

Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud. Subject to that, our total liability to you is limited to what you paid us in the twelve months before the claim.

We may update these terms. The date at the top of this page is the date of the version you are reading, and continuing to use the service after a change means you accept the new version. We do not have a way to email everyone about a change, so if the wording matters to you, check the date now and then.

These terms are governed by the law of Georgia, and its courts have jurisdiction. If you are a consumer, this does not deprive you of the protection of mandatory rules of law in the country where you live.
